Key Updates from This Week’s Tip Line
What You Need To Know
What’s happening?Supply chain priorities are shifting in some areas and holding steady in others. Here’s what your team should be paying attention to.
What's being discussed?
Commerciality preferred: The DoW continues to emphasize commerciality as the preferred procurement baseline.
Takeaway: While FAR Part 12 has always directed us to buy commercial, shift your focus away from proving commerciality and toward demonstrating that pricing is fair and reasonable.
Increased transparency for BAA and TAA: A public compliance database is expected in 2027, introducing greater visibility into Buy American Act (BAA) and Trade Agreements Act (TAA) compliance across supply chains.
Takeaway: Strengthen your price reasonableness documentation throughout your supply chain.
Long‑term ordering strategies: There is a growing focus on long‑term ordering strategies intended to support capacity planning within the defense industrial base.
Takeaway: More predictable demand may allow you to make longer-term investments in infrastructure, equipment, and workforce planning.
Tariffs and duty management oversight: We are seeing more attention from DCMA and the DoW on contractor controls related to tariffs, duty recovery, and refund processing.
Takeaway: Prepare now. Get in line for your tariff refund and create a documented workflow of your controls in the event of a spot check from DCMA or the DoW.
Tighter enforcement around BAA and TAA: Enforcement activity under the Buy American Act and Trade Agreements Act has increased.
Takeaway: Enhance your organization’s supply chain sourcing transparency and documentation.
CMMC positioning and audit: CMMC readiness continues to be a critical supply chain qualification requirement.
Takeaway: Many organizations have already been on-the-ball with becoming CMMC ready. The next challenge becomes securing timely C3PAO assessments. Reach out, and we’d be happy to help.
